4. Monthly Retainer Fees and Service Availability
Jeff Norton Digital's monthly retainer plans provide clients with ongoing access to professional technology services, account maintenance, reserved technical support capacity, and support availability according to their selected plan.
Monthly retainer fees cover more than the actual hours of technical services performed. Regardless of whether a client uses all allocated hours, Jeff Norton Digital incurs ongoing operational costs associated with:
- Maintaining the client's active service account.
- Reserving technical resources and support capacity.
- Maintaining on-call readiness and availability according to the selected service plan.
- Managing administrative and operational requirements necessary to maintain the service relationship.
These costs continue throughout the billing period, even when the client does not request or utilize technical support.
5. Hour Rollover Policy
All monthly retainer plans include 100% unused hour rollover within each customer's subscription quarter.
Subscription-Based Quarters: Rollover periods are based on each customer's individual subscription start date, not calendar quarters. Each subscription quarter consists of three consecutive monthly billing periods.
Rollover Rules:
- 100% of unused monthly support hours roll forward within the same subscription quarter.
- Hours may accumulate across the three monthly billing periods.
- Unused hours expire at the end of the subscription quarter.
- Hours never carry forward into a subsequent subscription quarter.
- Rolled-over hours are consumed before newly allocated hours.
- Rollover applies only to active retainer subscriptions.
- Unused or expired hours have no cash redemption value.
- Once unused hours roll over into a subsequent billing month, the associated fees become nonrefundable, subject to applicable law.
Maximum Available Hours (assumes no usage in preceding months):
- Starter: Up to 15 hours in Month 3.
- Business: Up to 30 hours in Month 3.
- Business Plus: Up to 60 hours in Month 3.
- Technology Partner: Up to 90 hours in Month 3.
6. Nonrefundable Rollover Hours
Once unused support hours have rolled over into a subsequent billing month, the fees associated with those hours are nonrefundable. This policy reflects the ongoing costs incurred by Jeff Norton Digital in maintaining active customer accounts, reserving technical resources, and maintaining support readiness. Unused hours do not create an automatic entitlement to refunds.
7. Quarterly Expiration
Unused support hours expire at the end of each customer's individual three-month subscription quarter. Expired hours cannot be transferred into a subsequent quarter or exchanged for cash.
8. Technology Assessment Credits
Clients who complete a Technology Assessment may apply credits toward future services under the following terms:
- The full $495 assessment fee may be credited toward an approved qualifying project of $1,500 or more when the project is approved within 30 days of the assessment.
- Alternatively, $250 may be credited toward a Business or higher monthly retainer plan with a minimum three-month commitment.
- Assessment credits cannot be combined.
- Credits must be applied within the specified timeframes.
9. Emergency Support
24/7 emergency request access is included with the Business Plus and Technology Partner plans. Emergency request access means the ability to submit urgent support requests outside standard business hours. It does not guarantee immediate response or resolution within a specific timeframe unless a separate service-level agreement has been established.
Starter and Business plan clients receive business-hours support only.
On-Demand clients receive business-hours support, subject to availability.
10. Payment Terms
All payments are processed through Stripe. For on-demand and project work, payment terms are established at the time of engagement. Monthly retainer fees are billed in advance at the beginning of each billing period. Nothing is released for payment until agreed-upon milestones are met, as applicable.
11. Cancellation
Monthly retainer plans may be cancelled with written notice. Upon termination of a retainer agreement, unused rollover hours are forfeited and are not eligible for cash redemption or refund, subject to applicable law and the terms of the service agreement.
Cancellation takes effect at the end of the current billing period. Services will continue through the end of the paid period.
12. The Jeff Norton Guarantee
Before work begins, Jeff Norton Digital and the client agree on the problem to be solved, the scope of work, and what constitutes a successful outcome. If Jeff Norton Digital cannot deliver the agreed-upon result, the client does not pay for that work.
This guarantee does not cover third-party costs including hardware, software licenses, cloud services, advertising spend, or other external expenses.
13. Limitation of Liability
Jeff Norton Digital provides technology services on a best-effort basis. Jeff Norton Digital is not liable for indirect, incidental, consequential, or punitive damages arising from the use of services, to the maximum extent permitted by applicable law.
Total liability for any claim arising from services provided shall not exceed the fees paid by the client during the six months preceding the claim.
14. Intellectual Property
Work product created by Jeff Norton Digital for a client becomes the property of the client upon full payment, unless otherwise specified in a separate agreement.
Jeff Norton Digital retains the right to use general knowledge, skills, and techniques developed during the course of providing services.
15. Confidentiality
Jeff Norton Digital will treat client information as confidential and will not disclose it to third parties without the client's consent, except as required by law.
16. Modifications
Jeff Norton Digital reserves the right to update these Terms with reasonable notice. Continued use of services after modifications constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Marion County, Florida, unless otherwise agreed.
18. Applicable Law Savings Clause
Nothing in these Terms is intended to waive or limit any rights or remedies available to either party under applicable federal, state, or local law. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
